1. Acceptance of Terms
Welcome to Aguilar Aesthetics Medspa & Wellness (“Aguilar Aesthetics,” “we,” “us,” or “our”), located at 2820 NE 214th Street, Office 905, Aventura, Florida 33180. These Terms and Conditions (“Terms”) govern your access to and use of our website (aguilaraesthetics.com), mobile applications, online booking systems, and all in-person services, treatments, products, and memberships offered by us.
By creating an account, booking a consultation or treatment, purchasing products, enrolling in a membership, or otherwise using our services, you confirm that you are at least 18 years of age (or have parental/guardian consent if under 18 where permitted) and that you accept these Terms in full.
2. About Aguilar Aesthetics
Aguilar Aesthetics Medspa & Wellness is a premier medical spa in Aventura, Florida, offering advanced aesthetic treatments and personalized wellness care under the supervision of a licensed physician and Medical Director, Dr. Ronaldo Calonje. Our team of experienced providers, including Physician Associates, delivers non-surgical and minimally invasive procedures in a safe, luxurious environment.
Our services include, but are not limited to:
- Injectable treatments (Botox, Dysport, Xeomin, dermal fillers, Sculptra, Radiesse, Kybella/PCDC)
- Laser and energy-based treatments (CO2 Face/Body, Morpheus8 Face/Body, Colormax)
- Facial and skin treatments (Hydrafacial, Chemical Peels, Microneedling, AquaGold, PDO Threads)
- Body contouring and rejuvenation (Non-Surgical BBL, Body Sculptra/Radiesse, Cellulite Improvement, Stretch Marks, Scar reduction)
- Wellness services (IV Therapy, Hormone Replacement, Weight Loss Program, Micronutrient Testing, Vitamin Boosters, Stem Cell)
- Other specialized treatments such as Hyperhidrosis management, Filler Dissolving, Hand Rejuvenation, Undereye Filler, Melasma treatment, and Post Lipo Fibrosis care
3. Medical Disclaimer and No Guarantee of Results
IMPORTANT: All aesthetic and wellness treatments involve inherent risks and potential side effects. Results vary significantly from person to person based on individual factors including age, skin type, lifestyle, medical history, and adherence to aftercare instructions.
By receiving services from Aguilar Aesthetics, you acknowledge and agree that:
- We do not guarantee specific aesthetic outcomes, permanence of results, or complete satisfaction with any treatment.
- All procedures carry risks, which will be discussed during your consultation. You have the right to ask questions and receive full informed consent before any treatment.
- Our services are not a substitute for primary medical care, emergency treatment, or specialist medical advice. We recommend consulting your primary care physician before starting any new treatment, especially hormone replacement or weight loss programs.
- You must provide accurate and complete medical history, current medications, allergies, and any relevant health information. Failure to disclose may increase risks and affect outcomes.
- Photographs and documentation may be taken for clinical records and, with your separate written consent, for marketing or educational purposes.
4. Eligibility, Consultations, and Informed Consent
Most treatments require a consultation to determine suitability. We reserve the right to refuse service to anyone if we determine, in our professional judgment, that a treatment is not appropriate or safe for the individual.
Prior to any treatment, you will be required to complete and sign informed consent forms specific to the procedure(s). These forms detail the nature of the treatment, expected benefits, potential risks and side effects, alternatives, and aftercare instructions. Your signature confirms that you have had the opportunity to ask questions and that you voluntarily consent to the treatment.
Certain treatments may have age restrictions, pregnancy contraindications, or other medical exclusions. You agree to disclose any such conditions truthfully.
5. Appointments, Cancellations, Rescheduling, and No-Shows
Booking: Appointments may be booked online, by phone at (754) 837-2717, via WhatsApp, or in person. A deposit or booking fee may be required to secure your appointment.
Cancellation / Rescheduling Policy: We require a minimum of 24 hours’ advance notice to cancel or reschedule an appointment without penalty. Notice must be given by phone, WhatsApp, or email.
Late Cancellations & No-Shows: Cancellations made with less than 24 hours’ notice, or failure to arrive for a scheduled appointment (“no-show”), may result in a cancellation fee of up to 50% of the scheduled service value or forfeiture of any deposit. Repeated no-shows may result in the requirement of full prepayment for future appointments or restriction of booking privileges.
Lateness: Arriving more than 15 minutes late may require rescheduling your appointment at our discretion to avoid impacting subsequent patients. In such cases, the cancellation policy may apply.
6. Payments, Pricing, Refunds, and Credits
Payment: Full payment is due at the time of service unless other arrangements have been made in writing. We accept major credit cards, debit cards, and other payment methods as displayed. Prices are subject to change without prior notice; however, the price quoted at the time of booking will generally be honored for that appointment.
Deposits: Deposits paid to secure appointments are non-refundable if the appointment is cancelled with less than 24 hours’ notice or in the event of a no-show. Deposits may be applied toward the cost of the treatment if the appointment is kept.
Refunds: Due to the personalized nature of aesthetic and medical spa services, all sales of services and treatments are final. We do not offer refunds for completed treatments, even if results do not meet personal expectations. In limited circumstances (e.g., treatment not performed due to medical contraindication discovered on the day), a credit toward future services may be issued at our sole discretion.
Product Sales: Retail skincare and related products are non-returnable once opened or used for hygiene and safety reasons. Unopened products may be returned within 14 days of purchase with original receipt for store credit only, at our discretion.
Package & Prepaid Services: Packages and prepaid treatment series are non-refundable and non-transferable. Unused sessions generally expire according to the terms stated at purchase (commonly 12 months from purchase date unless otherwise specified).
7. Membership Plans
If you enroll in any membership plan offered by Aguilar Aesthetics, the specific terms of that membership (including billing cycle, benefits, credits, pause options, and cancellation rules) will be provided at the time of enrollment and form part of these Terms. Key general principles include:
- Memberships are billed automatically according to the selected plan.
- Credits and benefits are non-transferable and for the enrolled member only.
- Unused credits typically remain valid while the membership is active; specific expiration rules after cancellation will be stated in the membership agreement.
- Cancellation or pausing of memberships must follow the procedures outlined in the membership terms. Re-enrollment fees may apply after extended pauses.
8. Website and Online Services
Our website and online booking tools are provided for your convenience. You agree not to misuse the website, attempt unauthorized access, introduce malware, scrape content, or engage in any activity that disrupts or harms our systems or other users. All content on the website (text, images, logos, videos) is owned by or licensed to Aguilar Aesthetics and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.
Online information, including treatment descriptions and pricing, is for general guidance only and does not constitute a medical recommendation or a binding offer until confirmed during an in-person or virtual consultation.
9. Privacy and Personal Information
We collect and process personal and health-related information in accordance with applicable laws, including HIPAA where applicable to medical records, and our Privacy Policy. By using our services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy (available on our website or upon request).
You may receive appointment reminders, follow-up messages, and occasional marketing communications via SMS, email, or phone. You can opt out of marketing communications at any time by following the unsubscribe instructions or contacting us. Standard messaging rates from your carrier may apply.
10. Limitation of Liability
To the maximum extent permitted by Florida and applicable federal law, Aguilar Aesthetics Medspa & Wellness, its owners, Medical Director, providers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, website, or products, including but not limited to loss of profits, data, or goodwill.
Our total liability for any claim arising from these Terms or the services provided shall not exceed the amount you paid to us for the specific service giving rise to the claim in the twelve (12) months preceding the claim.
Nothing in these Terms excludes or limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Aguilar Aesthetics Medspa & Wellness, its Medical Director, providers, staff, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your failure to disclose accurate medical information; (c) your misuse of products or failure to follow aftercare instructions; or (d) any injury or damage caused by your negligence or willful misconduct.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If unresolved, exclusive jurisdiction shall lie in the state or federal courts located in Miami-Dade County, Florida.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised “Last Updated” date. Continued use of our services or website after changes constitutes acceptance of the revised Terms. Material changes affecting ongoing memberships or prepaid packages will be communicated to affected clients when reasonably possible.
14. Severability and Entire Agreement
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with any informed consent forms, membership agreements, and our Privacy Policy, constitute the entire agreement between you and Aguilar Aesthetics regarding the subject matter hereof and supersede all prior or contemporaneous communications.
